Rules Acknowledgment, Assumption of Risk, Release, Waiver of Liability, Indemnification, and Hold Harmless Agreement
Play Station 653 prides itself on maintaining a safe, clean, and fun environment for our guests. Play Station 653 Rules are designed to promote safety and to allow each and every guest the opportunity to enjoy their time in the facility.
Guests that are unable or unwilling to follow facility rules will be asked to leave the premises. No refunds will be given. Play Station 653 LLC reserves the right to deny present and future entry to any guest(s) unwilling to follow the Rules or to those guest(s) who have committed a serious infraction, the determination of such infraction rests solely with Play Station 653 LLC.
This is a legally binding agreement. By signing this document, you are waiving certain rights, including the right to bring a lawsuit to recover damages if you are injured while participating in any activity at Play Station 653. Please read carefully before signing.
Play Station 653 means Play Station 653 LLC, its members, managers, officers, assigns, principals, any associated persons or companies, the physical premises of all business locations, as well as all business and service operations performed on behalf of Play Station 653 LLC.
Acknowledgment and Assumption of Risk
In consideration of my admission and participation at this facility, I acknowledge and willingly agree that:
I, and any minor children I am the parent or guardian of, are entering the business facility voluntarily and of our own free will.
I acknowledge that activities involve risk of injury, permanent disability, or death, including due to negligence of Play Station 653 or others.
I and my minor children are physically able to participate and know of no health condition that would limit our participation.
I accept full personal responsibility for any injury or damages, even if caused by the negligence of Play Station 653 or others.
I knowingly and freely assume all risks, known and unknown, and take full responsibility for our participation.
Release, Waiver of Liability
I hereby release, waive, discharge, and covenant not to sue Play Station 653, its members, managers, officers, agents, employees, and volunteers from any and all liability, claims, demands, actions, or causes of action, including injury or death, whether caused by their negligence or otherwise.
Indemnification and Hold Harmless Agreement
I agree to indemnify and hold harmless the Releasees from any loss or cost due to my or my minor children’s participation. This agreement extends to my family, spouse, heirs, and representatives.
Video Surveillance Acknowledgment
I understand that Play Station 653 may use video surveillance for safety and security, excluding private areas such as restrooms or dressing rooms. I consent to such surveillance during all visits.
Photograph and Model Release Acknowledgment
I consent to Play Station 653 using photos, videos, or media that include my likeness or that of my minor children. I waive all rights to royalties or approval of the final product. All media become the property of Play Station 653 and may be used for any lawful purpose.
Waiver/Release for Communicable Diseases Including COVID-19
In consideration of being allowed to use the facility, I acknowledge:
Participation may expose me to infectious diseases including COVID-19.
I assume all such risks, even if due to negligence.
I agree to comply with all rules to reduce transmission risks, such as hand washing, PPE use, temperature checks, and staying home when ill or exposed.
I will report concerns or hazards to staff and withdraw from participation if unwell.
I release Play Station 653 from any illness or damages arising from communicable disease exposure.
Parents & Caregivers Responsibilities
No adult or child may enter if showing signs of illness.
Parents must supervise their children at all times.
Address your child’s behavior promptly if it negatively affects others.
Report concerning behavior or conditions to staff.
Wash hands before and after play.
Respect session times and prepare to leave when sessions end.
Play Station 653 is not responsible for lost or stolen items.
Kids Responsibilities
Keep socks on at all times.
Be kind—no rough play, bullying, or tackling.
Play fairly and respectfully.
No outside toys in the play area.
Eat only in the Café.
Failure to Enforce is Not a Waiver
Failure to enforce any provision of this agreement does not waive rights. Only a written waiver signed by an authorized representative is valid.
Governing Law
This agreement is governed by Rhode Island law. If any part is found unenforceable, the remainder remains in effect.
Final Acknowledgment
I have read and understand this entire agreement.
I sign voluntarily and with full authority.
I am at least 18 years old and the parent, guardian, or authorized adult for listed minors.
I agree this waiver remains valid for ongoing participation.
I understand this agreement is binding on me, my heirs, and legal representatives.
